Terms/Conditions: The following terms outline responsibilities and expectations for both parties.
This contract contains three parts:
1) Summary of Information. 2) Terms/Conditions.
3) Music Request List/Planning Guide (sent separately).
ANATIME agrees to provide music, sound equipment, lights (if applicable) and at least one DJ at the venue as indicated on the Summary of Information. “Star Emcees” are considered ‘First-Class Services’ and may require an additional appearance fee.
The Venue: ANATIME is not responsible for the opening or closing of the venue or its management.
ANATIME requires a 2hr uninterrupted setup time immediately prior to the show’s start time. A 1hr tear-down time is also required immediately after show’s end. There are no extra fees for setup or tear-down times; however, if there is one flight or more of stairs or other hazards, there will be an additional $150.00 charge added to the quoted standard rate.
Please provide one banquet sized table and chair.
Operating area must also be located within 25’ of at least 2 independent electrical outlets free of all other loads.
If during the event the AC receptacles prove to be inadequate in supporting the music/sound equipment or lights the Client will NOT be entitled to a refund for interruption of services.
Safety: Client is responsible for providing adequate security to ensure safety of DJ personnel, equipment, Client, members of Client’s organization, engagement invitees, employees, or any other party in attendance, whether invited or not. ANATIME reserves the right to deny any guest access to the equipment. In the event the DJ believes an unsafe situation exists, he/she may call upon the Client to remedy the situation. Worst case, DJ may cease operation until the situation is resolved. The designated DJ/MC will not be held liable for any damage or harm to property or person, unless such is caused by gross or wanton negligence. ANATIME will take reasonable safeguards to protect its equipment and music media; however, any damage or theft occurring to any equipment or music media owned or leased by ANATIME because of negligent acts by Client or guests, either invited or not, will result in the Client being held responsible to pay for the damages or lost items. Typical damages may include (but not limited to) beverages (soda, alcohol, Etc.) spilled on the equipment, the kicking or knocking over of equipment, fire, theft of equipment, or riot situation.
It is understood that if this is a “Rain or Shine” event, ANATIME’s compensation is in no way affected by inclement weather. The DJ reserves the right, in good faith, to stop or cancel performance should the weather pose a potential danger to himself, the equipment, or audience. Every effort will be made to continue the performance; however, safety is paramount in all decisions. ANATIME’s nor DJ’s compensation will not be affected by such cancellation.
The designated DJ/MC and/or ANATIME will not be held liable for unavoidable detention by conditions or acts of God legitimately beyond control of the designated DJ/MC.
Payment Terms: A retainer will be required to reserve the event date and is due at contract signing. The retainer will count toward final balance. The Client hereby agrees to pay the total contract amount in full 14 business days prior to event date. If full balance is not received before this time period and no other payment arrangements are made and agreed upon by both parties, ANATIME reserves all rights to cancel engagement with Client forfeiting all payments. There will be an additional non-sufficient charge fee of $40.00 for returned checks.
Client is responsible for paying any charges imposed by the venue. These charges may include, but are not limited to, parking, use of electric power, police, and fire marshal.
Cancellation of this agreement by the Client is possible 30 calendar days or more in advance of the event; however, Client will forfeit any payments and/or retainers up to that point.
Extra hours of appearance and performance may be added during contract negotiations or during the event under the following guidelines: ANATIME does not guarantee the availability of the designated DJ/MC beyond contracted time; however, ANATIME will make every effort to accommodate a request for overtime performance for a nominal fee set by the DJ/MC. Overtime fees are due and shall be paid by the Client BEFORE the overtime performance. Before requesting that the DJ/MC provide overtime performance, the Client must ensure that the venue coordinator has approved the request.
In the unlikely event that the DJ/MC designated by ANATIME is unable to perform at the event, and a replacement cannot be found, ANATIME will make a full refund of payments. The Client acknowledges that ANATIME is responsible for scheduling the events for the designated DJ/MC as the booking agent only, and shall not be held liable for negligence, inactions, defaults, damages or non-performance of the designated DJ/MC, or his/her agents or employees.
Past performances may not be indicative of your production’s guidelines. Liability of ANATIME shall not exceed the total cost of services.
A written Event/Music Planning Guide must be received from the Client at least 14 business days prior to the date of the event for it to be included in ANATIME programming guidelines. With or without the aid of an event/music planning guide, ANATIME shall attempt to play Client’s music requests but shall not be held responsible if certain selections are unavailable. ANATIME and/or assigned Disk Jockey may exclude certain requested songs if it is deemed inappropriate to ANATIME’s standards and family values.
No performance at the engagement shall be recorded, reproduced, or transmitted from the place of performance, in any manner, or any means whatsoever, in the absence of a specific written agreement with ANATIME relating to and permitting such recording, reproduction, or transmission. Pictures/videotape of the event are permitted for the private use of the Undersigned Client and ANATIME’s promotional use only.
Service charges for Clients requiring travel outside of a 150-mile radius of our service area may require accommodations to be made for an overnight stay in a local and reputable hotel for ANATIME entertainers as well as reasonable travel expenses to be provided by Client.
By executing this contract as Client, the person executing said contract, either individually, or as an agent or representative, represents and warrants that he or she is eighteen (18) years of age, and further, that he or she has the authority to enter into this agreement and should he or she not have such authority, he or she personally accepts and assumes full responsibility and liability under the terms of this contract. All attached riders are an integral part of this contract. This contract will supercede any other contract. If any part of this contract is illegal or unenforceable, the remaining provisions of this contract will remain valid and enforceable to both parties.
In the unlikely event of a dispute arising between the Client and ANATIME, both parties agree to abide by the decision made under arbitration by the American Disc Jockey Association. If litigation for any item in this contract agreement is necessary, ANATIME shall be entitled to all reasonable attorney fees, court costs, and collection expenses. The City of Effingham, Co. of Effingham, and State of IL shall have venue if such action is necessary and that the interpretation and legal effect of this contract shall be governed by the laws of the State of Illinois.
This contract contains the entire agreement between the parties and no statement, promises, or inducements made by any party hereto, or agent or representative or either party hereto, which are not contained in this written contract, shall be valid or binding. This contract shall not be modified or altered except in writing by both parties and endorsed hereon.
